The quote above comes from the Hnifi version of Islamic Law and is found in Hedaya, Volume II, Book IX, page 141. It means that infidels may be attacked without provocation.
The Qur'an verses1 behind that passage from Islamic Law have no expiry, they are open ended,. Thus, the communal obligation to wage Jihad against disbelievers continues to the end of the world.
The quote above comes from Page 140 of Hedaya's second volume; it is a translator's note The Shafi'i school's Reliance of the Traveller, in Book O9.1. makes plain the fact that attacks against passive infidels are required annually; that all who know of the communal obligation are sinners if no attack is carried out when it is possible.
The first is when they are in their own countries, in which case jihad (def: o9.8) is a communal obligation, and this is what our author is speaking of when he says, "Jihad is a communal obligation," meaning upon the Muslims each year....

Objectors declare that Islam is a religion, an equally valid pathway to God. They pray and they sway so it must be ok. Was any legitimate religion founded for the personal emolument of its founder? Why do they attack us?
That is what Adams & Jefferson wanted to learn when they met Tripoli's Ambassador, so they asked him. At that time, we had no boots on the ground in Arabia or Asia and Israel was dominated by the Ottoman Empire.
Anything and everything Moe said while reciting the Qur'an and everything he did in pursuit thereof is the "law of the Prophet" After Moe died, Umar sent the army to fight nearby kingdoms. The Persians wanted to know why they were being attacked.
The orders to fight
Surah Al-Baqarah 2:216 makes it plain that Jihad4 is ordained for Muslims; a communal obligation. The next verse makes it plain that Jihad, in that context, means holy war.
2:217. They ask you concerning fighting in the Sacred Months (i.e. 1st, 7th, 11th and 12th months of the Islâmic calendar). Say, "Fighting therein is a great (transgression) but a greater (transgression) with Allâh is to prevent mankind from following the Way of Allâh, to disbelieve in Him, to prevent access to Al-Masjid-al-Harâm (at Makkah), and to drive out its inhabitants, and Al-Fitnah is worse than killing. And they will never cease fighting you until they turn you back from your religion (Islâmic Monotheism) if they can. And whosoever of you turns back from his religion and dies as a disbeliever, then his deeds will be lost in this life and in the Hereafter, and they will be the dwellers of the Fire. They will abide therein forever."
The primary Jihad imperatives are found in Surah Al-Anfal and Surah At-Taubah. Note that there is no mention of their being defensive in nature and no geographic or chronological limits on these imperatives.
9:29. Fight against those who (1) believe not in Allâh, (2) nor in the Last Day, (3) nor forbid that which has been forbidden by Allâh and His Messenger (4) and those who acknowledge not the religion of truth (i.e. Islâm) among the people of the Scripture (Jews and Christians), until they pay the Jizyah with willing submission, and feel themselves subdued.
Sahih Bukhari 1.8.387 is one of several hadith which confirm the Jihad imperatives. It also brings unpleasant facts to light:
- Our blood and property are not sacred to Muslims: The season is open and we can be attacked with impunity.
- As disbelievers, we have no human rights; we only obtain them by becoming Muslims.
Narrated Anas bin Malik:
Allah's Apostle said, "I have been ordered to fight the people till they say: 'None has the right to be worshipped but Allah.' And if they say so, pray like our prayers, face our Qibla and slaughter as we slaughter, then their blood and property will be sacred to us and we will not interfere with them except legally and their reckoning will be with Allah." Narrated Maimun ibn Siyah that he asked Anas bin Malik, "O Abu Hamza! What makes the life and property of a person sacred?" He replied, "Whoever says, 'None has the right to be worshipped but Allah', faces our Qibla during the prayers, prays like us and eats our slaughtered animal, then he is a Muslim, and has got the same rights and obligations as other Muslims have."
The Jihad imperatives are codified into Shari'ah, in The Reliance of the Traveller O9.8 & 9.9.
The caliph fights all other peoples until they become Muslim (O: because they are not a people with a Book, nor honored as such, and are not permitted to settle with paying the poll tax (jizya) ) ...
Where is the defensive or retaliatory element in those provisions of Islamic law? To see clear confirmation of the obvious, turn to O25.9 where waging war against neighboring infidels is listed as an eighth duty of subordinate rulers.
What motivates Muslims?
Terrorists are motivated by Allah's threat and promise because they are believers5. If they were hypocrites, whose Islam goes no deeper than their throats, they would not be planting bombs. On resurrection day, Allah will weigh their sins against their good deeds. The swing of the balance determines where they spend eternity, Paradise or Perdition.
Allah's threat
A Muslim who does not join the Jihad when called will be damned.
9:39. If you march not forth, He will punish you with a painful torment and will replace you by another people, and you cannot harm Him at all, and Allâh is Able to do all things.
Allah's promise
A Muslim who joins the Jihad with good intentions will have his sins forgiven and be admitted into Paradise.
61:11. That you believe in Allâh and His Messenger (Muhammad ), and that you strive hard and fight in the Cause of Allâh with your wealth and your lives, that will be better for you, if you but know!
61:12. (If you do so) He will forgive you your sins, and admit you into Gardens under which rivers flow, and pleasant dwelling in Gardens of 'Adn Eternity ['Adn (Edn) Paradise], that is indeed the great success.
61:13. And also (He will give you) another (blessing) which you love, help from Allâh (against your enemies) and a near victory. And give glad tidings (O Muhammad ) to the believers.
The minimum number of wives in Paradise is two. The maximum number is 72. The quantity and quality of food and wine the Muslim gets and the number of virgins he gets is a function of which of the 100 levels of Paradise he is admitted to, which is a function of the balance of his sins and good deeds. How can a Muslim gain extra credit toward an upgrade in Paradise? By any step taken to injure or enrage disbelievers: ACTS OF TERRORISM! . This fact is clear on the face of the text in 9:120.
Why do they hate us?
Muslims hate us because we are not them. Why? Because Allah hates us; we are accursed, the worst of creatures who must be punished, defeated and gathered into Hell. Muslims love what Allah loves and hates what Allah hates. The concept is called Wala Wal Bara.
They hate us and attack us because we ain't Muslims; nothing short of sincere conversion to Islam will change that. If we want to stop the attacks, we must deport all Muslims and exclude them from entering. There is no acceptable alternative.
