    In a long and detailed post, Mark Durie argues that one edition of the Hilali/Khan Qur'an translation, because of it's commentary, tends towards radicalization, inciting violence.

There is not a Bible, Jewish or Christian, containing such incendiary commentary as populates page after page of 'The Noble Qur’an', which for four years has preached to the faithful in Canberra Airport's prayer room. The ideology it promotes is violent jihad. It is a book to start a war.

    Is there any evidence that anyone has ever taken that Qur'an from it's shelf and read it?   If they did, would they read  the fine print in the foot notes?  How many Muslims read Allah's book in their native tongue?    One research report puts Qur'an literacy at or below the 50% mark depending on  location and age. Use the Ctrl F search, for read and take the third result.

    Classical Arabic from the 7th century lacked vowels and diacritical marks so there were seven variant readings. Vocabulary and idioms have changed, so Joe Camel can't understand the Qur'an even if he can read modern Arabic.  Joe Camel needs a tafsir.  Tafsir Ibn kathir comes in ten volumes.  If Joe Camel has $200. handy, he can buy a set. If he has internet access and a large hard disk, he can get it free but it will take up 2.87 gigabytes.

    What does it really mean?  Only Muhammad knew for sure. His interpretation is in hadith collections. Sahih Bukhari  is said to be the most rigorous of the muhadditin, winnowing down 600,000 hadith to about 4700 discrete sayings. The 9 volume set will nearly destroy a pair of hundred dollar bills. Or you can download it from the archive.

    For obvious readons, most Muslims get their knowledge of Islam from their Imam or from the likes of Anwar al-Awlaki & Yusuf al-Qaradawi.  So where do the experts get their knowledge?  Ain't it obvious?

    The conquests of Arabia, Syria, Asia and the Balkans happened long before publication of this edition in 1985.   How do you explain that if  TNQ is the root of all evil?

Compare a few translations from Islam Awakened.

  • Literal
    • Fight those who (do) not believe in Allah and not in the Day the Last, and not they make unlawful what Allah has made unlawful and His Messenger, and not they acknowledge (the) religion (of) the truth, from those who were given the Scripture, until they pay the willingly, while they (are) subdued.
  • Shakir
    • Fight those who do not believe in Allah, nor in the latter day, nor do they prohibit what Allah and His Messenger have prohibited, nor follow the religion of truth, out of those who have been given the Book, until they pay the tax in acknowledgment of superiority and they are in a state of subjection.
  • Hilali/Khan
    • Fight against those who (1) believe not in Allah, (2) nor in the Last Day, (3) nor forbid that which has been forbidden by Allah and His Messenger (4) and those who acknowledge not the religion of truth (i.e. Islam) among the people of the Scripture (Jews and Christians), until they pay the Jizyah with willing submission, and feel themselves subdued.

What are Muslims commanded to do, to whom and why? Is there any defensive element in that verse? Does it mention being attacked first?

    Ibn Kathir provides plenty of detail in his tafsir.  Read the left hand facing page first, for 9.28. Mekkans worried about loss of revenue from prohibiting pagan hajj. Allah gave them 9.29 as a revenue replacement: jizya! 

    Consider the title of this tafsir:  "The Order to fight People of the Scriptures until They
give the Jizyah".  it implies offensive jihad, not defensive.

    What is the meaning of this: "Allah
commanded His Messenger  to fight the People of the
Scriptures, Jews and Christians, on the ninth year of Hijrah,
and he prepared his army to fight the Romans and called the
people to Jihad announcing his intent and destination." ???

What did Allah command Moe to do?   He commanded him to attack the Byzantine Empire!! But the command is without geographic or chronological limits and has no expiration date. It is always valid.   Take a close look at the footnote.

 (V.9:29) a) See the footnote of (V.2:193)
b) Narrated Abu Hurairah 4»l ; Allah’s Messenger  said, “The Hour
will not be established untill you fight against the Jews, and the stone behind which a Jew
will be hiding will say, 'O Muslim! There is a Jew hiding behind me, so kill him’ ” (Sahih Al-
Bukhari, Vol.4, Hadith No. 177)
c) Jizyah: a tax levied from the people of the Scriptures (Jews and Christians), who are
under the protection of a Muslim government.

M (A) (V. 2:193) Narrated Ibn ‘Umar  Allah’s Messenger
said, “I have been ordered (by Allah) to fight against the people till they testify that
L i ilih a illa llih wa Anna Muhammmad-ur-Rasul A llih (none has the right to be
worshipped but Allah 3 y. and that Muhammad  is the Messenger
of Allah), and perform As-Salit (Iqimat-as-Salat) and give Zakit, so if they
perform all that, then they save their lives, and properties from me except for
Islamic laws, and their reckoning (accounts) will be with (done by) Allah.” (Sahih
Al-Bukhiri, Vol.1, Hadith No.24).
   
    In the first instance, the infamous genocide hadith is quoted. In the second,  a hadith  in which caliph Umar quotes Moe as saying you save your wealth and life from Moe by reciting shahada. 

    Take another look at the body of the ayat: did Hilali & Khan add anything to it or change it's meaning?  They only explained and confirmed the meaning by adding footnotes with exegesis and hadith.

    How did Moe interpret 8.39 & 9.29?  he marched on Tobuk, didn't he?  He did what Allah commanded him to do! Here are the relevant ahadith:

Narrated Anas bin Malik:
Allah's Apostle said, "I have been ordered to fight the people till they say: 'None has the right to be worshipped but Allah.' And if they say so, pray like our prayers, face our Qibla and slaughter as we slaughter, then their blood and property will be sacred to us and we will not interfere with them except legally and their reckoning will be with Allah." Narrated Maimun ibn Siyah that he asked Anas bin Malik, "O Abu Hamza! What makes the life and property of a person sacred?" He replied, "Whoever says, 'None has the right to be worshipped but Allah', faces our Qibla during the prayers, prays like us and eats our slaughtered animal, then he is a Muslim, and has got the same rights and obligations as other Muslims have."

Bukhari Volume 4, Book 52, Number 196:
Narrated Abu Huraira:
Allah 's Apostle said, " I have been ordered to fight with the people till they say, 'None has the right to be worshipped but Allah,' and whoever says, 'None has the right to be worshipped but Allah,' his life and property will be saved by me except for Islamic law, and his accounts will be with Allah, (either to punish him or to forgive him.)"

Sunan Abu Dawud  14.2635
    Narrated Anas ibn Malik:

    The Prophet (peace_be_upon_him) said: I am commanded to fight with men till they testify that there is no god but Allah, and that Muhammad is His servant and His Apostle, face our qiblah (direction of prayer), eat what we slaughter, and pray like us. When they do that, their life and property are unlawful for us except what is due to them. They will have the same rights as the Muslims have, and have the same responsibilities as the Muslims have.


    The ayat says Fight those who. The tafsir says order to fight. The relevant ahadith say ordered or commanded to fight. Who can connect the dots?  Who has a clue?  Do you?

    How about the Islamic jurists, what do they say about  9.29? "Reliance Of The Traveller cites it as the scriptural source of a perpetual war rule outlined in o9.1 and made explicit in o9.8, which I quote.

o9.8: The Objectives of Jihad

The caliph (o25) makes war upon Jews, Christians, and Zoroastrians (N: provided he has first invited them to enter Islam in faith and practice, and if they will not, then invited them to enter the social order of Islam by paying the non-Muslim poll tax (jizya, def: o11.4) -which is the significance of their paying it, not the money itself-while remaining in their ancestral religions) (O: and the war continues) until they become Muslim or else pay the non-Muslim poll tax (O: in accordance with the word of Allah Most High,

"Fight those who do not believe in Allah and the Last Day and who forbid not what Allah and His messenger have forbidden-who do not practice the religion of truth, being of those who have been given the Book-until they pay the poll tax out of hand and are humbled" (Koran 9.29),

the time and place for which is before the final descent of Jesus (upon whom be peace).  After his final coming, nothing but Islam will be accepted from them, for taking the poll tax is only effective until Jesus' descent (upon him and our Prophet be peace), which is the divinely revealed law of Muhammad. The coming of Jesus does not entail a separate divinely revealed law, for he will rule by the law of Muhammad. As for the Prophet's saying (Allah bless him and give him peace),

"I am the last, there will be no prophet after me,"

this does not contradict the final coming of Jesus (upon whom be peace), since he will not rule according to the Evangel, but as a follower of our Prophet (Allah bless him and give him peace) ).

    The caliph makes war on Jews, Christians and Zoroastrians until they pay Jizya.  He does it because of the command in 9.29. Note the condition precedent: issuance of dawa prior to attack!  Would the caliph waste time inviting aggressors to Islam if he was under attack?  No! This law proves the offensive nature of Jihad!!   The requirement to invite to Islam before attacking is confirmed in Hedaya & Risala  


    In the matter of Jizya: see hedaya, page 211.... for the gritty details of Islamic law. What looks like an elongated f is really an s. Once you get past that, you should be able to read the text.  Read the Noble Qur'an here. Read volume 4 of Sahih Bukhari here

    This is a pull your head out of the sand moment: Islam: belief in Allah, his imperatives, threat and promise is the problem, not any single book or edition. Muslims believe that Allah is the almighty creator, who commands them to conquer the world for his good pleasure, in return for which he will admit them to his celestial orgy. But if they do not fight in his cause, he will damn them. That makes Islam a perpetual war machine. We need to eliminate belief in Allah. Eliminating one edition of the Qur'an is not sufficient.

Jihad Is Not Defensive!!! Muslims, dhimmis & apologists falsely assert that Jihad is exclusively defensive. Islamic law proves them to be liars. I am exhibiting and providing links to the relevant pages of the legal codes of the Hanafi, Maliki & Shafi'i schools of Islamic law.
Read them and understand that Jihad is offensive & aggressive, undertaken on Islamic initiative.

For the benefit of those who can not tolerate the archaic font, archaic vocabulary and poor print quality, I present a cleaned up version of the substantive part of the vital paragraph. with bold emphasis added.

When the Muslims enter the enemy's country, and besiege the cities or strong holds of the infidels, it is necessary to invite them to embrace the faith, because Ibn Abbas relates of the prophet that " he never destroyed any without previously inviting them to embrace the faith. " If, therefore, they embrace the faith, it is unnecessary to war with them, because that which was the design of the war is then obtained without war.  The prophet, moreover, has said "we are directed to make war upon men until such time as they shall confess there is no God but one God; but when they repeat this creed, their persons and properties are in protection."  ---If they do not accept the call to the faith, they must then be called upon to pay Jizya, or capitation-tax; because the prophet directed the commanders of his armies so to do; and also, because by submitting to this tax, war is forbidden and terminated, upon the authority of the Koran.

    I have now exhibited to you relevant passages from the Islamic law of the Hanafi, Maliki & Shafi'i schools of Islamic law. The three agree that it is necessary to invite infidels to Islam before attacking them.

    The Shafi'i fiqh specifically gives Surah At-Taubah 9.29 as its scriptural basis; take a close look at it: 

9:29. Fight against those who (1) believe not in Allâh, (2) nor in the Last Day, (3) nor forbid that which has been forbidden by Allâh and His Messenger (4) and those who acknowledge not the religion of truth (i.e. Islâm) among the people of the Scripture (Jews and Christians), until they pay the Jizyah with willing submission, and feel themselves subdued.

Click through, read the entire surah and see if there is any defensive element in it.  Then read Ibn Kathir's tafsir of 9.29; is defense mentioned therein?

    Would Muslims be required to issue dawah before attacking if infidels were attacking them?  Risala explicitly answers in the negative.

    Moe's orders to his commanders in the field are reported in Sahih Muslim 19.4294. I quote the pertinent part.
If they refuse to accept Islam, demand from them the Jizya. If they agree to pay, accept it from them and hold off your hands. If they refuse to pay the tax, seek Allah's help and fight them...


    When Umar sent the Muslim army to Persia, a Persian general asked why they were attacking. The answer is found in Sahih Bukhari 4.53.386; I quote the pertinent part.
Our Prophet, the Messenger of our Lord, has ordered us to fight you till you worship Allah Alone or give Jizya (i.e. tribute); and our Prophet has informed us that our Lord says:-- "Whoever amongst us is killed (i.e. martyred), shall go to Paradise to lead such a luxurious life as he has never seen, and whoever amongst us remain alive, shall become your master."

8.39  9.29 are fight...until loops with compound terminal conditions Neither one has any element of defense in its text or context.  9.123 has neither defensive element nor terminal condition.  What did Moe say about them?

Sunan Abu Dawud 14.2635
    Narrated Anas ibn Malik:

When Allah's Apostle died and Abu Bakr was elected as a Caliph after him, some of the Arabs reverted to disbelief, 'Umar said to Abu Bakr, "How dare you fight the people while Allah's Apostle said, I have been ordered to fight the people till they say 'None has the right to be worshipped but Allah' And whoever says: None has the right to be worshipped but Allah.' saves his wealth and his life from me unless he deserves a legal punishment justly, and his account will be with Allah! Abu Bakr said, "By Allah, I will fight him who discriminates between Zakat and prayers, for Zakat is the Compulsory right to be taken from the wealth By Allah, if they refuse to give me even a tying rope which they use to give to Allah's Apostle, I would fight them for withholding it." 'Umar said, 'By Allah, It was nothing, except I saw that Allah had opened the chest of Abu Bakr to the fight, and I came to know for certain that was the truth."


    The Profit said he was commanded/ordered to fight with men/the people until they recite shehada and do things his way. There is no element of defense in any of the ahadith relating to the Jihad imperative.

So Islam is "a great religion of peace" ? Explain these topic titles from Ibn Kathir's Tafsir. Click them and read their contents.  Why did Allah  command and order Muslims to commit aggression?

So terrorism is haram? Explain these tafsir which explain 8:60 and 8:12!!


    In Tafsir Ibn Kathir, you see the ayat which enjoin offensive warfare and the ahadith which confirm them, but you do not see their practical application.  For that you must turn to Shari'ah: Islamic law which is based on the Qur'an & hadith.

    Reliance of the Traveller is the most well known codification of Shari'ah. It reflects the fiqh of the Shafi'i school of Islamic law.  It is divided into books, each of which bears a letter as its name. Book O codifies the laws related to justice, including the definition, communal obligation & performance of jihad. 

    Reliance defines Jihad as "war against non-Muslims". It is a communal obligation, binding on all eligible male Muslims until a sufficient number have responded to the front.  Jihad must be performed in every year, and it is performed against disbelievers while they are in their own countries, peacefully minding their own affairs.

    The caliph makes war against Jews, Christians and Zoroastrians until they are subjugated and submit to annual extortion payments called jizya.  He fights all other peoples until they become Muslims. 

    That is not my opinion, I did not pull it out of any orifice, it is plain and clear on the face of the text of Reliance of the Traveller, which is certified authentic and accurate by sheikhs of  al-Azhar University at Cairo.  

    Would you like a second opinion? Try Risala, the handbook of fiqh belonging to the Maliki school of Islamic Law.  Risala defines jihad as " a technical term for the Muslim fighting the unbelievers who have no treaty with the intention of elevating the word of Allah or presenting Islam". Muslims must invite disbelievers to Islam. If they reject Islam, they must demand jizya. If  refused, they must wage war. 

    Would you like a third opinion?  Try Hedaya, the handbook of fiqh belonging to the Hanifi school of Islamic Law.  From Hedaya, we learn that jihad must be undertaken at all times by some party of the Muslims.  We learn that "destruction of the sword is incurred by infidels even though they be not the first aggressors".   We also learn that jizya is a punishment for infidelity and a payment in lieu of destruction.

White House Shari'ah Rally: What Do They Want?

I learned from a Daily Mail article that three infamous British Muslims have been asked to address a pro Shari'ah rally at the White House March 3, 2011. The event is sponsored by the International Institute of Islamic Thought.   If we had rational and patriotic leaders in power, Anjem Choudary, Abu Izzadeen and Sayful Islam would be denied visas.

    The theme of the rally is supposed to be exhortation to rise up and impose Shari'ah on America. Literally the "path to life giving waters", Shari'ah is a codification of the laws laid down in the Qur'an & hadith. 

    The Sunnis comprise the majority of Muslims and the Shafi'ite school of jurisprudence is the most widely accepted of the Sunni schools. Its handbook of fiqh is Reliance of the Traveller and Guide to the Faithful.

    I have included images from a pdf file scanned from Reliance of the Traveller. Click them to view full sized images. Lest you doubt the authenticity of the text, I included two certifications of authenticity, from al-Azhar & IIIT. 

    Reliance is divided into topical books. Book o treats of "Justice"; chapter 9 treats the law of jihad, beginning with a definition:

09.0 JIHAD
(0: Jihad means to war against non-Muslims,
and is etymologically derived from the word
mujahada, signifying warfare to establish the
religion.[...]


The text cites several verses of the Qur'an and hadith to back that up.  o9.1 discusses the communal obligation of waging war against infidels, which is "meaning upon the Muslims each year"  Islamic law requires a minimum of one military expedition against infidels in every year. 

    O9.8 reveals the practical application of that communal obligation.

o9.8 Thc caliph (025) makes war upon Jews,
Christians, and Zoroastrians (N: provided he has
first invited them to enter Islam in faith and practice,
and if they will not, then invited them to
enter the social order of Islam by paying the nonMuslim
poll tax (jizya, def: 01 L4)-which is the
significance of their paying it, not the money

The text continues with the scriptural basis of the ruling, which is 9:29.  Note the similarity of expression used by J.M. Rodwell.

Make war upon such of those to whom the Scriptures have been given as believe not in God, or in the last day, and who forbid not that which God and His Apostle have forbidden, and who profess not the profession of the truth, until they pay tribute out of hand, and they be humbled.


    O9.9 follows up with warfare against pagans.

09.9 The caliph fights all other peoples until
they become Muslim (0: because they are not a
people with a Book, nor honored as such, and are
not permited to settle with paying the poll tax...


Imam Faisal Abdul Rauf and other advocates of Shari'ah won't tell you about those provisions, why not? 

    There are important considerations other than violence. The concept of equality is one of them.  Consider what chapter 24 says about testimony.

024.2 Legal testimony is only acceptable from a
witness who:
(a) is free;
(b) is fully legally responsible (mukallaf, def:
c8.1) (0: as testimony is not accepted from a child
or insane person, even when the child's testimony
regards injuries among ehildren that oeeurred at
play);
(e) is able to speak;
(d) is mentally awake;
(e) is religious (0: meaning upright (024.4)
(A: and Muslim), for Allah Most High says,
"Let those of rectitude among you testify"
(Koran 65:2),
and unbelief is the vilest form of corruption, as
goes without saying);


If you ain't Muslim, you can't be a witness!  Let that sink in for a moment. Read it again.  What do you think about Shari'ah now?  The testimony of a man is worth that of two women.

024.7 The testimony of the following is legally
acceptable when it concerns cases involving property,
or transactions dealing with property, such
as sales:
(1) two men;
(2) two women and a man;
(3) or a male witness together with the oath
of the plaintiff.


Why is the feminist movement silent about this?


    In England and some American states, there is pressure for application of Shari'ah to domestic matters; family disputes.  The laws concerning marriage are laid out in book m.  I will raise one quote from that book, containing a concept which will cause any rational and compassionate person to reject Shari'ah.

GUARDIANS WHO MAY MARRY A VIRGIN
TO A MAN WITHOUT HER CONSENT
m3.13 Guardians are of two types, those who
may compel their female charges to marry someone,
and those who may not.
(1) The only guardians who may compel
their charge to marry are a virgin bride's father or
father's father, compel meaning to marry her to a
suitable match (def: m4) without her consent.
(2) Those who may not compel her are not
entitled to marry her to someone unless she
accepts and gives her permission.
Whenever the bride is a virgin, the father or
father's father may marry her to someone without
her permission, though it is recommended to ask
her permission if she has reached puberty. A virgin's
silence is considered as permission.
As for the nonvirgin of sound mind, no one
may marry her to another after she has reached
puberty without her express permission, no matter
whether the guardian is the father, father's
father, or someone else.


Let that sink in for a moment.  Read it again. Do you want Shari'ah to be applied here?  Why/why not??

    Divorce is one of the more important family law matters. Under Shari'ah, a husband need only declare divorce three times to give it legal effect.

n1.3 The person conducting the divorce may
effect it himself or commission another (def:
k17.5-6) to do so, even if the person commissioned
is a woman.
The person commissioned may effect the
divorce at any time (0: provided the one who
commissions him does not cancel the commission
before the divorce takes place (dis: k17.16»,
though when a husband tells his wife. "Divorce
yourself," then if she immediately says, "I divorce
myself," she is divorced, but if she delays, she is
not divorced unless the husband has said, "Divorce
yourself whenever you wish."

n2.1 A free man has three pronouncements of
divorce (0: because of the word of Allah Most
High,
"Divorce is two times, then retain with kindness
or graciously release" (Koran 2:229),
and when the Prophet (Allah bless him and give
him peace) was asked about the third time, he
said,
"It is Allah's having said, 'or graciously
release' ").

    Reliance is not the only handbook of Islamic law, though it is the most popular. Others are generally less detailed in some matters. Al-Hedaya is not as easy to read but it explains the differences between Shafi'ite and Hanifi fiqh. 

    For the Maliki fiqh on jihad, turn to chapter 30 of Risala, which offers less detail than Reliance.  The Hanifi fiqh of jihad is in  al-Hedaya, Vol. II, Book IX, Chapter 1.

    The fiqh of wudu & prayer tends to be arcane, nonsensical and harmless to us. But the Islamic law regarding war is totally unacceptable, as is the inequality of women and religious minorities.  The concepts of arbitrary divorce & forced marriage are so repugnant as to compel vigorous objection to imposition of Shari'ah. 

    Let us therefore rise up as one with a loud voice shouting HELL NO!!! to those who demand imposition of Islamic law.  Let us support the state legislation designed to ban it and make demands for national legislation to prevent the imposition of Shari'ah in the federal courts.

Saqib's Al-Taqiyya: Misquote & Context

The comment included in this post is illustrative of the professional practice of al-taqiyya.  The  deception is very slickly executed,  difficult for the uninitiated to detect and counter.



Saqib has left a new comment on your post "Qur'an: Read it before Burning it":

But if they turn away, catch them and slaughter them wherever ye find them; and (in any case) take no friends or helpers from their ranks.” (4:89)

This verse has been misquoted like the previous verse, out of context. Here is the full passage:

4:88-91 Why should ye be divided into two parties about the Hypocrites? Allah hath upset them for their (evil) deeds. Would ye guide those whom Allah hath thrown out of the Way? For those whom Allah hath thrown out of the Way, never shalt thou find the Way. They but wish that ye should reject Faith, as they do, and thus be on the same footing (as they): so take not friends from their ranks until they forsake the domain of evil in the way of God (from what is forbidden). But if they revert to [open] enmity, seize them and slay them wherever ye find them; and (in any case) take no friends or helpers from their ranks. Except those who join a group between whom and you there is a treaty (Of peace), or those who approach you with hearts restraining them from fighting you as well as fighting their own people. If God had pleased, He could have given them power over you, and they would have fought you: therefore if they withdraw from you but fight you not, and (instead) send you (guarantees of) peace, then God hath opened no way for you (to war against them). Others you will find that wish to gain your confidence as well as that of their people: every time they are sent back to temptation, they succumb thereto; if they withdraw not from you nor give you (guarantees) of peace besides restraining their hands, seize them and slay them wherever ye get them; in their case We have provided you with a clear argument against them

So in the same manner as the first verse, this verse also only commands Muslims to fight those who practice oppression or persecution, or attack the Muslims. And in the event of a battle, the same laws of war are in place and a Muslim who transgresses limits should prepare for the punishment of God. In response to a question on verses 4:88-89, Dr. Muzammil H. Siddiqi quotes the verses in their full context and then asks the following:

Now tell me honestly, do these verses give a free permission to kill any one anywhere? These verses were revealed by God to Prophet Muhammad (peace and blessings be upon him), at the time when Muslims were attacked by the non-Muslims of Makkah on a regular basis. They were frightening the Muslim community of Madinah. One may say using the contemporary jargon that there were constant terrorist attacks on Madinah and in this situation Muslims were given permission to fight back the “terrorist”. These verses are not a permission for “terrorism” but they are a warning against the “terrorists.” But even in these warnings you can see how much restraint and care is emphasized. It is also important to note that the Qur’an clearly condemns murder. The Qur’an says about the prohibition of murder,

6:151 Take not life, which God hath made sacred, except by way of justice and law: thus does He command you, that ye may learn wisdom. 17:33 Nor take life, which God has made sacred, except for just cause. And if anyone is slain wrongfully, We have given his heir authority (to demand Qisas(retribution) or to forgive): but let him not exceed bounds in the matter of taking life; for he is helped (by the law) 5:32…if any one slew a person - unless it be for murder or for spreading mischief in the land - it would be as if he slew the whole people: and if any one saved a life, it would be as if he saved the life of the whole people


    The cited verse: 4:89 is quoted exactly once in the post: in the context of a quote from Reliance of the Traveller, the handbook of Shafi'ite Fiqh.  Here is the relevant portion of the quote, part of the legal definition of  jihad.

Fortunately for us, Islamic law includes a clear and unambiguous definition of jihad. For clarity and ease of exploration, I have added emphasis and links to external references.
o9.0: Jihad
(O: Jihad means to war against non-Muslims, and is etymologically derived from the word mujahada signifying warfare to establish the religion. And it is the lesser jihad. As for the greater jihad, it is spiritual warfare against the lower self (nafs), which is why the Prophet (Allah bless him and give him peace) said as he was returning from jihad.
``We have returned from the lesser jihad to the greater jihad.''
The scriptural basis for jihad, prior to scholarly consensus (def: b7) is such Koranic verses as:
-1- ``Fighting is prescribed for you'' (Koran 2:216);
-2- ``Slay them wherever you find them'' (Koran 4:89);
-3- ``Fight the idolators utterly'' (Koran 9:36);

    Notice that three ayat were cited in Reliance o9.0.  I added links to the Noble Qur'an translation by Hilali & Khan published by the King Fahd Complex.  Any reader who is interested can click the links, read the full quotes, context and translator's footnotes.  The quoted expression does not occur in the Noble Qur'an, it only turned up in Reliance. If we substitute kill for slay, we find more appropriate quotes.
  • 2:191. And kill them wherever you find them, and turn them out from where they have turned you out. And Al-Fitnah is worse than killing. And fight not with them at Al-Masjid-al-Harâm (the sanctuary at Makkah), unless they (first) fight you there. But if they attack you, then kill them. Such is the recompense of the disbelievers. 
    • In this context, the reference is to defensive or retaliatory jihad. But see the footnote to the previous ayat, which contains a similar definition of jihad.
  • 4:89. They wish that you reject Faith, as they have rejected (Faith), and thus that you all become equal (like one another). So take not Auliyâ' (protectors or friends) from them, till they emigrate in the Way of Allâh (to Muhammad ). But if they turn back (from Islâm), take (hold) of them and kill them wherever you find them, and take neither Auliyâ' (protectors or friends) nor helpers from them. 
    • In context, this ayeh is in reference to hypocrites who abandoned faith in Islam and or refused to join the jihad.
  • 9:5. Then when the Sacred Months (the Ist, 7th, 11th, and 12th months of the Islâmic calendar) have passed, then kill the Mushrikûn (see V.2:105) wherever you find them, and capture them and besiege them, and prepare for them each and every ambush. But if they repent and perform As-Salât (Iqâmat-as-Salât), and give Zakât, then leave their way free. Verily, Allâh is Oft-Forgiving, Most Merciful. 
    • This is the infamous "verse of the sword" , its reference is  to the pagans of Mecca, it is related to offensive, not defensive jihad.
    If I was writing Umdat al-Salik, I would cite 9:5 instead of 4:89, but the operative text is the same, and the book was written hundreds of years before my birth.

    In the context of the quoted section of Reliance, the cited ayat are used to illustrate the meaning of jihad: "to war against non-Muslims".  The definition did not specify whether the jihad is defensive or offensive.

    I do not need to prove  that Reliance is perfect.  It could have been written better, but that is not up to me. Reliance is accepted as authentic by Islam's highest academic authorities. The certification  from Al-Azhar is on page 16.

    Maliki Fiqh also defines Jihad and reveals that it refers to offensive warfare. I direct doubters & dissenters to Book 30, Page  284 of the pdf version of Risala.

30.1 Its meaning
[ Linguistically jihad is derived from jahd, which, acording to al-Misbah, is effort in what someone
does, or juhd which is ability. It is a technical term for the Muslim fighting the unbelievers who have
no treaty with the intention of elevating the word of Allah or presenting Islam.

30.2b. Inviting people to Islam first
And it is preferable, according to us, that the enemy are not fought until they have been invited
to the din of Allah except if they attack first.
[The Malikis prefer that each group be called upon to abandon their disbelief and be called to the
shahada whose contents are not prescribed. He calls to the general message of the Prophet for three
days in succession unless they attack first. Then the call is not recommended. Indeed, it becomes
obligatory to fight them.]
30.2c. Offering a choice between Islam and jizya
They can either accept Islam or pay the jizya (tax on non-Muslims); if not they are to be fought.

    Now it is time to deal with Saqib's question: " Now tell me honestly, do these verses give a free permission to kill any one anywhere?"
No, they do not, nor do they exhaust the Qur'an's rich vein of violent verses. They were used specifically to illustrate the defination of Jihad Asghar.  No claim was made by me that those verses sanction killing in general.

    There is a verse often cited by Muslims: 5:32, which they use to "show" that Islam is "peaceful".

5:32. Because of that We ordained for the Children of Israel that if anyone killed a person not in retaliation of murder, or (and) to spread mischief in the land - it would be as if he killed all mankind, and if anyone saved a life, it would be as if he saved the life of all mankind. And indeed, there came to them Our Messengers with clear proofs, evidences, and signs, even then after that many of them continued to exceed the limits (e.g. by doing oppression unjustly and exceeding beyond the limits set by Allâh by committing the major sins) in the land!.


How peaceful and benevolent! Killing one is as bad as killing all mankind, saving one life carries the merit of saving the human race.  Ain't that sweet?  Muslims love to accuse us of "cherry picking" and quoting verses out of context. So why do they conceal the next verse in context?  Who has heard or seen them quoting 5:33?

5:33. The recompense of those who wage war against Allâh and His Messenger and do mischief in the land is only that they shall be killed or crucified or their hands and their feet be cut off on the opposite sides, or be exiled from the land. That is their disgrace in this world, and a great torment is theirs in the Hereafter.

    This verse  prescribes hudud for those who "wage war against Allah".  They shall be killed, crucified, mutilated or be exiled.  What is the meaning of "wage war against Allah"?  The verse does not tell us, but Ibn Kathir reveals the meaning in his tafsir.

"`Wage war' mentioned here means, oppose and contradict, and it includes disbelief, blocking roads and spreading fear in the fairways."

"Waging war against Allah" includes disbelief.   Muslims are prohibited from killing innocent people, but only Muslims are innocent, all others are rebels against Allah.  Got a clue yet?

    In the post upon which Saqib commented, I quoted Reliance of the Traveller o9.8 , which codify the offensive jihad imperative found in  9:29 .  Those are outcome oriented fight... until loops with compound terminal conditions and neither chronological nor geographic limits.

     Islamic law says "The caliph makes war upon Jews..."  and "The caliph fights all other peoples...". Here is the link:  o9.8   o9.9 is on the next page.   I also provided a link to  Reliance of the Traveller, Book o9.1  but did not quote it. That section describes the communal obligation to perform jihad   Saqib wants us to believe that Muslims only fight in self defense, never offensively. But his assertion is devastated by o9.1.

o9.1: The Obligatory Character of Jihad
Jihad is a communal obligation (def: c3.2).  When enough people perform it to successfully accomplish it, it is no longer obligatory upon others (O: the evidence for which is the Prophet's saying (Allah bless him and give him peace),
"He who provides the equipment for a soldier in jihad has himself performed jihad,"
and Allah Most High having said:
"Those of the believers who are unhurt but sit behind are not equal to those who fight in Allah's path with their property and lives. Allah has preferred those who fight with their property and lives a whole degree above those who sit behind. And to each, Allah has promised great good" (Koran 4:95).
If none of those concerned perform jihad, and it does not happen at all, then everyone who is aware that it is obligatory is guilty of sin, if there was a possibility of having performed it. In the time of the Prophet (Allah bless him and give him peace) jihad was a communal obligation after his emigration (hijra) to Medina. As for subsequent times, there are two possible states in respect to non-Muslims.
The first is when they are in their own countries, in which case jihad (def: o9.8) is a communal obligation, and this is what our author is speaking of when he says, "Jihad is a communal obligation," meaning upon the Muslims each year.
The second state is when non-Muslims invade a Muslim country or near to one, in which case jihad is personally obligatory (def: c3.2) upon the inhabitants of that country, who must repel the non-Muslims with whatever they can).

    I added emphasis to several crucial clauses. Muslims wage war against non-Muslims in their own countries and they do it every year.   There is another quote from Al-Shafi'i which erases all doubt.



    Muslims pretend that we are stupid, ignorant and gullible fools incapable of independent research and thought.  They dream that we can be diverted and distracted off onto dead end tangents.  But I have presented in this blog the ayat, ahadith, tafsir & fiqh relevant  to offensive jihad.  Those documents form a congruent pattern which makes  objective factual reality easy to perceive.

    In determining the meaning of the Qur'an, we are not limited to tafsir and scholarly analysis. We have the advantage of history.  Moe hired scribes to whom he dictated extortion letters. He  dispatched his companions to deliver those letters and afterwards, he followed up with his army.

In the name of Allah, the Compassionate, the Merciful

From Muhammad, the Prophet of Allah who is like Moosa (Moses A.S.) a prophet and messenger and he testifies to what Moosa (A.S.) had brought.

0 people of Torah, has Allah not stated in the Torah that "Muhammad (Sal Allaho Alehe Wasallam) is a Prophet of Allah. The people who will be with him, shall be harsh towards the enemies of Allah. And amongst themselves, they shall be kind and loving. They shall bow and prostrate before Allah. And they shall seek His bounty and goodwill".

I ask you to swear by Allah, who sent Torah for you and who made your forefathers eat 'mann, and 'Salva' and dried sea for them and rid them of the tyranny of pharaoh. It is not written in Torah that you should believe in me?

After the explanation about me in the Torah, do guidance and transgression become apparent?

Therefore I invite you towards Allah and His Prophet.'

Sahih Bukhari Volume 4, Book 52, Number 143:
Narrated Anas bin Malik:
The Prophet said to Abu Talha, "Choose one of your boy servants to serve me in my expedition to Khaibar." So, Abu Talha took me letting me ride behind him while I was a boy nearing the age of puberty. I used to serve Allah's Apostle when he stopped to rest. I heard him saying repeatedly, "O Allah! I seek refuge with You from distress and sorrow, from helplessness and laziness, from miserliness and cowardice, from being heavily in debt and from being overcome by men." Then we reached Khaibar; and when Allah enabled him to conquer the Fort (of Khaibar), the beauty of Safiya bint Huyai bin Akhtab was described to him. Her husband had been killed while she was a bride. So Allah's Apostle selected her for himself and took her along with him till we reached a place called Sad-AsSahba,' where her menses were over and he took her for his wife. Haris (a kind of dish) was served on a small leather sheet. Then Allah's Apostle told me to call those who were around me. So, that was the marriage banquet of Allah's Apostle and Safiya. Then we left for Medina. I saw Allah's Apostle folding a cloak round the hump of the camel so as to make a wide space for Safiya (to sit on behind him) He sat beside his camel letting his knees for Safiya to put her feet on so as to mount the camel. Then, we proceeded till we approached Medina; he looked at Uhud (mountain) and said, "This is a mountain which loves us and is loved by us." Then he looked at Medina and said, "O Allah! I make the area between its (i.e. Medina's) two mountains a sanctuary as Abraham made Mecca a sanctuary. O Allah! Bless them (i.e. the people of Medina) in their Mudd and Sa (i.e. measures)."

    For those who can not  read between the lines and connect the dots, I present another letter which leaves nothing to the imagination.

LETTER TO THE CHIEFS OF AQABA

In the name of ALLAH the compassionate, the Merciful

From Muhammad, Prophet of Allah

To the People of Aqaba

May peace be on you. I praise Allah who is one and except whom there is nobody else to be worshipped.

I do not intend to wage war against you till you receive my written reason for it. It is better for you, either to accept Islam or agree to pay Jiziya and consent to remain obedient to Allah, His prophet and his messengers. My messengers deserve honour. Treat them with respect. Whatever pleases my messengers, will also please me.

These people have been informed of the orders about Jiziya. If you desire that there should be peace and security in the world, obey Allah and His Prophet. Thereafter none in Arabia and Ajam (Iran) shall dare cast an evil eye on you. But the rights of Allah and His Prophet can at no time be waived.

If you do not accept these terms and set them aside, I do not need your presents and gifts. In that case, I shall have to wage war (to establish peace and security). Its result would be that the big ones shall be killed in war and the commoners shall be taken prisoners.

I assure you that I am a true Prophet of Allah. I believe in Allah, and His Books, and His Prophets and am of the faith that Maseeh (Messiah) son of Mariam (Mary), is a Prophet of Allah and His word.

Hurmala (Raziallah AnhoA.) who brought to me 3 wasaq (about 6 quintals) of barley, recommended your case. Had it not been in compliance of the command of Allah and the good opinion of Hurmala for you, it would not have been necessary for me to correspond with you and instead of it, there would have been a war. If you will obey my messengers, you shall immediately have my support and the help and support of everyone who is attached to me.

My messengers are Shuraih-beel, Obaiy, Hurmala and Hurais (Raziallah AnhoA.) and whatever decision they take in respect of you, shall be acceptable to me.

Your people are under the protection and responsibility of Allah and His Prophet.

Supply provisions to the Jews of Maqna, for their journey to their country.

If you accept obedience, may peace be on you.'
